Based on the Federal law on the protection of personal data held by private individuals, published on July 5th 2010 in the Federal Official Gazette (Diario Oficial de la Federaci\u00f3n), FOMENTO EDUCACIONAL, A.C. located at Avenida Paseo de la Reforma No. 450-D, Colonia Lomas de Chapultepec, Delegaci\u00f3n Miguel Hidalgo, Mexico City, postal code 11000, Tel. (55) 5543-7126 and email address: info@fomentoeducacionalc.org.mx is responsible for collecting, processing and protecting the personal data from individual natural persons.<\/span><\/p>\n

<\/p>\n

Processing of personal data: (i) identification data; (ii) contact information; including (iii) sensitive personal data of the natural person, hereinafter referred to as the \u201cHolder\u201d who voluntarily and expressly provides to FOMENTO EDICACIONAL, A.C. will have the following main purposes according to the case: his or her identification, location and contact; registration of entry and exit of the facility; registration in various databases depending on their nature such as contact, visitor, supplier, service provider, lessor, lessee, sub lessor, sub lessee, beneficiary, donor, sponsor, social services provider, intern, volunteer, worker; preparation of contracts, agreements, waivers, letters of commitment, or any other document; preparation and integration of files depending on their nature; verify information on the Holder; filling out forms and\/or documents; providing requested services, products and information; integration and, when applicable, updating a phone book of suppliers, professional service providers, lessors, lessees, sub lessors, sub lessees, beneficiaries, sponsors, donors, volunteers, among others; sending physical mail or email; creating a registry of beneficiaries, sponsors, donors or volunteers, if applicable; purpose of studies, analysis and research, filling out releases for use of image; issuing digital invoices (CFDI); for payment; to verify the information of the Holder; sending information to the Holder on behalf of the Association or the government or companies that support the Association, as well as transfer to third parties if strictly necessary; which will have the following secondary purposes: preparation of a document; creation of reports and statements, statistical and promotional purposes, as well as communicating on changes in services and\/or products.<\/span><\/p>\n

<\/p>\n

For the above mentioned purposes, the personal data we need to obtain on behalf of the Holder may include but is not limited to, the following: first name(s), paternal last name, maternal last name, date of birth, place of birth, home address, and\/or work address and\/or fiscal address, landline number and\/or mobile number, email address, nationality, gender, marital status, occupation, Federal Taxpayer Registry (RFC), Unique Code of Population Registration (CURP), professional background, university or college the person graduated from, professional license number (c\u00e9dula profesional), postgraduate certificate, postgraduate studies, master\u2019s degree, PhD, university or college the person studied the postgraduate certificate, postgraduate studies, master\u2019s degree or PhD, credit or debit card number for donations, name of the banking institution, validity of the credit or debit card number, bank branch number, bank account number, CLABE number (Mexican banking standard numbering of bank account) for deposits, among others. The sensitive personal data may consist of racial or ethnic origin, current or future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions or sexual preference.<\/span><\/p>\n

<\/p>\n

FOMENTO EDUCACIONAL, A.C. may obtain the personal data and\/or sensitive personal data from the Holder through different means, including:<\/span><\/p>\n

<\/p>\n

In a personal manner: When the Holder provides his personal data and\/or sensitive personal data directly at the facility of the association.<\/span><\/p>\n

<\/p>\n

Directly: When the Holder provides his personal data and\/or sensitive personal data via email, on the phone, through the website www.fomentoeducacionalac.com.mx or any other electronic, optical, audio, visual means or via any other current or future technology.<\/span><\/p>\n

<\/p>\n

Indirectly: By any other means as permitted by law.<\/span><\/p>\n

<\/p>\n

On the other hand, we would like to inform you that the personal data and sensitive personal data you have provided to FOMENTO EDUCACIONAL, A.C. may be transmitted to third parties and processed outside of the country, thus the Holder accepts that FOMENTO EDUCACIONAL, A.C. will transmit his personal data and\/or sensitive personal data to any other party, whether a domestic or foreign natural person or legal entity; or government agencies or entities, while the Association has the obligation to inform them about the content of this Privacy notice as well as the objectives to which the processing of these data is subject to, with the understanding that a receiving third party will assume the same obligations that correspond to FOMENTO EDUCACIONAL, A.C.<\/span><\/p>\n

<\/p>\n

In case the Holder does not express his opposition to the transfer of his personal data and\/or sensitive personal data to third parties, in the manner and upon the terms described above, FOMENTO EDUCACIONAL, A.C. will assume that the Holder has given his tacit consent to do so.<\/span><\/p>\n

<\/p>\n

The Holder has the right to access the personal data and\/or sensitive personal data he provided to FOMENTO EDUCACIONAL, A.C. and the processing details, as well as to correct them in case they are inaccurate or incomplete; to cancel their use when he considers they are not required for any purpose indicated in the present Privacy notice or they are being used for purposes he didn\u2019t consent to; or to object to the processing of them for specific purposes, known as ARCO rights (access, rectification, cancellation and objection).<\/span><\/p>\n

<\/p>\n

At all times, the Holder may revoke his consent given to FOMENTO EDUCACIONAL, A.C. for the processing of his personal data and\/or sensitive personal data, so that the Association stops using them.<\/span><\/p>\n

<\/p>\n

The mechanisms implemented to exercise the ARCO rights and the right of withdrawal in terms of the provisions of the Federal law on the protection of personal data held by private individuals are: (i) Through the submission of the respective request to the Department of Personal Data Protection of FOMENTO EDUCACIONAL, A.C. located at Avenida Paseo de la Reforma No. 450-D, Colonia Lomas de Chapultepec, Delegaci\u00f3n Miguel Hidalgo, Mexico City, postal code 11000; (ii) Contacting the number (55) 5543-7126; or (iii) Sending an email to info@fomentoeducacionalc.org.mx ; afterwards you should confirm by phone to ensure the proper receipt. The procedure to respond to revocation requests and those related to the exercise of any ARCO right is available on the website: www.fomentoeducacionalac.com.mx<\/span><\/p>\n

<\/p>\n

The request must include, but is not be limited to, the following: a) Full name of the Holder, address, contact phone number, email or any other means to communicate the request response to; (ii) Documents establishing the Holder\u2019s or his legal representative\u2019s identity; (iii) A clear and precise description of the personal data and\/or sensitive personal data he would like to access or correct; or the request of objection or cancellation of the processing of personal data and\/or sensitive personal data he may have provided, or the request of revocation of the consent to the processing of personal data and\/or sensitive personal data or the objection thereof, to ensure that FOMENTO EDUCACIONAL, A.C. stops making use of them. The response to the request will be sent within 15 (fifteen) working days from the reception date by the Association.<\/span><\/p>\n

The Holder\u2019s personal data and\/or sensitive personal data will be kept strictly confidential, in accordance with the security, administrative, technical and physical measures that FOMENTO EDUCACIONAL, A.C. implements for that purpose in its security policies and procedures, its unlawful disclosure is prohibited and its use by third parties is limited, as set out in the provisions of this Privacy notice.<\/span><\/p>\n

<\/p>\n

In order to comply with the provisions of the law, we reserve the right to make any changes or updates to the text of this Privacy notice, the regulation or the requirements of the Association.<\/span><\/p>\n

These modifications will be available on the website www.fomentoeducacionalac.com.mx or will be sent to the last email address the Holder provided.<\/span><\/p>\n

If you believe that your right to personal data protection has been infringed by the conduct of our employees or by our actions or responses; or if you believe that there has been a violation of the provisions set out in the Federal law on the protection of personal data held by private individuals during the processing of your personal data, you may file a respective complaint or grievance with the Federal Institute for Information Access and Data Protection (Instituto Federal de Acceso a la Informaci\u00f3n y Protecci\u00f3n de Datos, IFAI).
